Versión en español: Condiciones Generales
Note: This is an English translation of the General Terms and Conditions (AGB) originally drafted in German, provided as a courtesy for our English-speaking customers. In the event of any discrepancy between this version and the original German version, the German version shall prevail.
These General Terms and Conditions apply to all services between Alemán de Primera – Academia Virtual, represented by its owner Patricia Pieke, Jägerstr. 63D, 10117 Berlin, Germany — hereinafter referred to as the Provider — and the customer, in the version valid at the time of the order.
Specifically, the services comprise the following online offerings: trial lessons, group courses, small-group courses, thematic workshops, exam preparation, courses for children, individual lessons, job-application coaching, business German, corporate courses, translation and interpreting. Detailed information on each offering can be found in the corresponding product description on the offers page.
The following provisions apply to contracts concluded by email, telephone, other means of remote communication, or via e-commerce through our online shop.
If a contract is concluded, it is concluded with the Provider named above.
The presentation of services in our online shop does not constitute a legally binding contractual offer on our part; it is merely a non-binding invitation to the customer to order services. By ordering the desired service, the customer submits a binding offer to conclude a purchase contract.
Upon receipt of an order in our online shop, the following provisions apply: the customer submits a binding contractual offer by going through the ordering process provided in our online shop, which consists of the following steps:
(1) Selection of the desired service.
(2) Confirmation by clicking the “Añadir al carrito” (“add to cart”) button.
(3) Review of the details in the “Carrito” (“shopping cart”).
(4) Clicking the “Finalizar compra” (“checkout”) button.
(5) Entering the billing details, reviewing again and, if necessary, correcting the information entered.
(6) Selecting the payment method, optionally subscribing to the free newsletter (“I would like to receive exclusive emails with discounts and product information.”).
(7) Confirming and agreeing to the General Terms and Conditions (AGB), the right of withdrawal, the privacy policy, the use of Zoom Cloud Meetings (privacy policy available at https://explore.zoom.us/docs/de-de/privacy.html), and Proton Docs (privacy policy available at https://proton.me/de/legal/privacy) by ticking the corresponding checkbox (“I have read and expressly agree to the General Terms and Conditions / AGB (https://aleman-de-primera.de/agb/) of the website and specifically to the terms of use of Zoom Cloud Meetings and Proton Docs for educational purposes. I have been informed of my right of withdrawal.”).
(8) Binding submission of the order by clicking the “Realizar el pedido” (“place order”) button.
Before submitting the order in a binding manner, the customer may, by using the “back” button of the web browser used, return to the page on which the customer’s details are recorded after reviewing the order, and correct any input errors, or cancel the ordering process by closing the web browser. We confirm receipt of the order by an automatically generated email (subject: “¡Hemos recibido tu pedido en Alemán de Primera!” / “We have received your order at Alemán de Primera!”).
We will send you the order details, the AGB, and further course information, as well as the invoice, by email. You can view our AGB at any time at https://aleman-de-primera.de/agb/. For security reasons, your order data will no longer be accessible via the Internet.
Orders may also be placed by email, telephone, or other means of remote communication. In this case, we will send you, as described above, a confirmation email with the order details and further course information, as well as the AGB and the invoice, thereby accepting your contractual offer.
The prices stated are final prices and, where applicable, exempt from VAT pursuant to § 4 No. 21 a) bb) of the German VAT Act (UStG). Details can be found on the invoice. As these are virtual services, no shipping or return costs apply. If a lesson does not take place online, an additional expense allowance of €10.00 per teaching day will be charged for travel to the place of instruction.
The customer may pay using the payment methods offered in the online shop (including PayPal) or by bank transfer. In both cases, the customer is obliged to pay immediately upon conclusion of the contract, but in any case at least five business days before the start of the service. Should the customer fail to comply with this obligation, they will be in default even without a reminder, and the Provider reserves the right to cancel the planned lessons.
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform the Provider,
Patricia Pieke, Alemán de Primera – Academia Virtual, Jägerstr. 63D, 10117 Berlin, Germany; email: info@aleman-de-primera.de,
by means of a clear statement (e.g., by email) of your decision to withdraw from this contract. You may use the model withdrawal form attached below, although this is not mandatory.
To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.
If you withdraw from this contract no later than five business days before the start of the course, we will reimburse all payments we have received from you, less a cancellation fee of €49.00, without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. If you have made a payment for multiple people, a cancellation fee of €49.00 per person will apply.
If you withdraw from the contract at a later point in time, or if the service has already begun during the withdrawal period or you have already partially made use of it, we will not be able to issue a refund, as this could result in the cancellation of the course for all participants, which would unreasonably compromise planning certainty for our other customers and for us.
If you have already been granted access to your virtual course workbook, where included in the course, you must pay compensation equal to the price paid by the Provider for that book.
For the reimbursement, we will use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; you will not be charged any fees as a result of this reimbursement.
(If you wish to withdraw from the contract, please complete this form and return it to us by post or email.)

The Provider is obliged to maintain confidentiality regarding internal matters that come to its knowledge in the course of the contractually agreed activity, in particular trade secrets and details of the cooperation as well as of members or bodies of the customer, and not to disclose documents to third parties, unless these are facts or circumstances that merely correspond to the general state of the art or are otherwise publicly known. This shall also apply after the service has been rendered.
Insofar as copyrights in its work results arise from the activities of Alemán de Primera – Academia Virtual, in particular in teaching materials and concepts, presentations, Proton Docs content, notes, whiteboard recordings, videos, and other teaching materials, these shall belong exclusively to the Provider, free of charge, without limitation, irrevocably, and non-transferably, for use and any possible application.
It is not permitted — without the express written consent of the Provider — to share or reproduce any teaching materials, photos, videos, or other information with third parties. In particular, posting such content on social media channels is prohibited. Any violation will result in exclusion from participation in the lessons and, if applicable, further legal action.
In case of doubt, or to request express written consent, please contact Alemán de Primera at info@aleman-de-primera.de.
Lessons take place via the video conferencing software Zoom Cloud Meetings (privacy policy available at https://explore.zoom.us/docs/de-de/privacy.html). To ensure effective participation in lessons, it is the customer’s responsibility to provide the technical equipment, i.e., to ensure a good internet connection and a quiet environment, or alternatively to wear headphones/a headset. If a participant cannot guarantee this, the teacher has the right to mute them, if necessary, to prevent disruption to other participants. For active participation in lessons, an internet-enabled device with an adequate screen size is also recommended, i.e., preferably a PC or laptop. Screenshots or recordings of video meetings are expressly prohibited!
Lessons are documented, among other means, using the online word-processing program Proton Docs. The teaching materials made available there and by other means will remain accessible to participants for the entire duration of the course and for up to one week after the course ends. Participants are permitted to download and/or print these materials for personal use; however, passing them on to third parties is prohibited, in particular publication on the internet and via social media channels.
Neither the use of Zoom Cloud Meetings nor of Proton Docs involves any costs for participants, and both can be used without prior registration.
When participating in an intensive course, it is possible to be added to the corresponding study group, which is generally managed via Signal (privacy policy available at https://signal.org/legal/#privacy-policy). The participant submits the request via this free-to-use messenger service, and the Provider subsequently authorizes them to join the group. Here too, the sharing of data or materials with unauthorized third parties is not permitted, in particular publication on the internet or via social media channels.
Teachers and learners undertake not to use without authorization, nor to disclose to unauthorized third parties, personal data of other participants or teachers of which they have become aware in the course of their participation or their teaching/translation/interpreting activities.
The Provider reserves the right to permanently exclude individual participants or teachers from lessons if they disrupt the lessons, behave inappropriately toward other participants or teachers, or if there is reasonable suspicion that a learner or teacher is knowingly violating the provisions agreed in this contract or endangering the interests of other participants, teachers, or the Provider.
An individual lesson can be cancelled free of charge if the cancellation is received by the Provider (e.g., via info@aleman-de-primera.de) by 12:00 noon (German time) on the preceding business day, and not merely by the respective teacher. An official cancellation can no longer be revoked. If the session is not cancelled in time, but the participant is nevertheless unable to attend the lesson, the Provider shall be entitled to full payment for the missed lesson(s).
If a participant is late, they are obliged to notify the Provider and/or the teacher immediately. In principle, the teacher is obliged to wait at least 20 minutes for the participant, even without notification. After this time, the teacher may leave the meeting room and the session shall be deemed not cancelled, so that the Provider shall be entitled to full payment for the planned lesson(s).
A small-group lesson can be cancelled free of charge if the cancellation is received by the Provider (e.g., via info@aleman-de-primera.de) by 12:00 noon (German time) on the preceding business day, and not merely by the respective teacher, and with the agreement of all participants. An official cancellation can no longer be revoked. If the session is not cancelled in time, but one or all participants are nevertheless unable to attend the lesson, the Provider shall be entitled to full payment for the missed lesson(s).
Group courses take place even if individual participants cancel. Lessons cannot be made up individually for specific persons, but are documented, including homework, in the Proton Doc assigned to the course and can be easily reviewed. The course fee cannot be reduced due to the absence of an individual participant.
Should a course need to be cancelled on our part, for example due to failure to reach a minimum of five learners in group courses or due to illness of the teacher, the amount paid for that course will be refunded to the customer in full and as quickly as possible. The cancellation of the course does not entitle the customer to the provision of an equivalent course or to any claim for damages.
This provision applies to all types of courses we offer and also applies to cancellations on the day the course begins.
Should one or more provisions of this agreement be or become invalid, the validity of the contract as a whole shall remain unaffected. In such a case, the invalid contractual provision shall be replaced by another valid provision that most closely achieves the purpose intended by the contracting parties.
In the event of a breach of these AGB, Alemán de Primera reserves the right to exclude the participant concerned from lessons with immediate effect and to take further legal action.
The language of the contract is German. The place of jurisdiction is Berlin, Germany. This agreement, as well as any claims arising therefrom, shall be governed exclusively by German law.
